iTunes Class Action Settlement in the Works

Apple customers who have purchased an iTunes gift card could gain benefits under a new class action settlement.

A recent lawsuit filed against Apple Inc. claimed that Apple advertised, distributed, and sold 99¢ iTunes gift cards. In April 2009, Apple raised the price of certain songs at the iTunes Store from 99¢ to $1.29, an action in which the lawsuit claims that 99¢ iTunes gift card holders who purchased $1.29 songs were overcharged.

This proposed settlement could affect those who have purchased an Apple iTunes gift card with the printed words on the packaging containing the phrase “songs are 99¢” or any other wording suggesting that iTunes songs are priced at 99¢. 

A $3.25 iTunes Store credit can be provided if customers purchased or received a 99¢ iTunes gift card and used it to purchase one or more $1.29 songs from the iTunes Store on or before May 10, 2010. Those who qualify may submit an online Claim Form to ask for the credit.

To participate in the settlement, an online Claim Form available at www.JohnsoniTunesSettlement.com/FileAClaim must be submitted by September 24, 2012. The Court will hold a hearing on the case of Johnson v. Apple Inc. on February 10, 2012 to determine whether to approve the settlement.
