Alleged COD Stabber 'Not a Thug,' Attorney Says

Jamie Smith is accused in the Sept. 1 stabbing of a former teammate at a Palm Desert apartment complex.

There’s more to the story in the case of a football player accused in the stabbing of a former teammate in Palm Desert, the man’s attorney said Monday.

Jamie Smith – a 19-year-old transfer student from North Carolina A&T -- faces attempted murder and other charges in the at an apartment complex in the 77700 block of Country Club Drive.

“We feel compelled to reach out and encourage people to suspend judgment. There are two sides to the story,’’ said Mark McBride, a Beverly Hills attorney who is representing Smith along with Justin Sanders, an attorney who is also based in the Los Angeles area. 

Sanders said they were hired last week by Smith’s parents to “go all the way.”

“We’re pulling out all the stops to win this case,” he said.

McBride said more details about the night that led to Smith’s arrest and the end of his football career at COD would emerge throughout the course of the trial.

“He comes from a good family. He’s not a thug,” McBride told Patch.

McBride said he believes that Smith will be found not guilty of attempted murder.

“This is not a life case. This isn’t one,’’ he said.

But prosecutors allege that Smith is charged appropriately based on witness statements.

“We have more than one witness that said the victim tried to get away from the fight,’’ said John Hall, a spokesman for the Riverside County District Attorney’s Office.

During a fight, the 19-year-old victim slipped at some point, Hall said.

“The defendant continued after the victim and stabbed him multiple times on the upper body while the victim was on the ground,’’ he said.

The victim was taken to a hospital for treatment, according to sheriff’s investigators.

The fight apparently stemmed from a dispute between the classmates, sheriff’s officials said.

Coach Dean Dowty has said Smith, who is being held in lieu of $1 million at the Indio Jail, would be expelled from the team.

Smith is due back in court on Oct. 21 for a felony settlement conference at the Larson Justice Center in Indio.

In response to the article, McBride called the District Attorney's Office comments on the case "a disgrace to any notion of a fair criminal process."

He asked the public to "not prejudge our client's case."

Jared..maybe they wanted him closer to home and maybe his grades weren't good enough for him to get into a "better" school ...or maybe he had friends who go to COD...

First thing First..I LOVE U BRO MORE THAN ANYTHING AND YOUR IN MY PRAYERS!! second..yall dont even lknow the whole story you all just know what the papers are saying..like the articale said theres two sides to the story..yes what he did was wrong but i know for a fact my brother isnt a thug..he a nice,respectable young man! he's always been a bright student and team player..he was successful in highschool and middle in anything he put hias mine to..i know that he was caught in a situatuon where he made a bad decision but thats fine because his fam&&friends are behind him 100% in north carolina and chicago!! We love you J!!

how can you call someone a thug who was defending himself?? so that means everybody that defends themselves are thug??? o yea and jared it doesnt matter how much money his family has its where he wanted to go school at and where he chose to go...pretty sure he could have went ANYWHERE he wanted to go....and if you were in a situation like this im pretty sure your parents would want the best to get you out i would hope so... his family and friends love him and are behind him 100% because we know him and he is not a thug far from it....o a black man stabbed somebody so that makes him a thug??? if a white man did it would he be a thug???? or then would it be self defense??? lol rite...

I was wondering how long it would take for the race card to be thrown out there. The whole story is possibly not all out there, but from my stand point, if someone came into my home and started to fight me, and if I was REALLY in danger (such as if they had a weapon and were about to kill me), then yes, I'd probably bust out the knife to defend myself. Would I use it? Most likely not. But I'm not in that situation, so I don't know until I'm there. However, if they came in to my home to "attack" me, and it was fist to fist, they had no weapon and my life was never in jeopardy, would I bust out a knife, no. Again, not in situation. Fancy lawer or not, only defendant will live with the real truth. Not the truth created in the media, in his fantasy world of it was just or not, but the real truth. Whether it was self defense or not. (My "opinion" is that self defense would be one stab, not multiple)

This is all insane to me. Who are any of you to place judgement on anyone? I'll wait... So he is a thug because he was in a fight that ended badly? If you weren't there then how can you claim if it was self-defense or not? Stabbing someone multiple times while trying to defend yourself sounds pretty possible to me. And what does it matter what college he goes to and what attorney he has? I'll wait... Ignorance can be bliss. Being that clearly none of you know anything about the case and also was not there I think you should keep your "thug" comments and negative things to yourself. Leave it to the people who get paid to do it. As for you Jamie. Keep your head up, you and your family is in my prayers.

If opinions don't matter, why get so upset over it? I honestly think race has nothing to do with it, and its a shame you even brought it up. If you read back to articles about that jerk that killed the little girl, her father, and wounded her grandmother, you will also see a whole bunch of negative opinions. He was Mexican. Or that article of that white man with the long hair (honestly forgot his crime) but you'll find a whole bunch of negative comments as well. Its like you've been saying this whole time, know what you are saying before you comment. You cannot claim the race card when there have been so many other cases with different races and the same negative opinions. Just because you are related or dating this guy, you can't take it so personal. You are not being attacked, are provoking the attacks. Now THAT is just my personal OPINION. I almost lost my little brother over stupidity! How do you run after someone and stab them more then 3 times and call that self defense? My brother dying on the hospital bed 2 times shouldn't be tooken lightly. I hope justice is serve. Seeing my little brother in the position that he is in breaks my heart; picturing him bleeding to death while being stab multiple times kills me. Only a monster has a heart to comit such a crime. Love thank you so much for making it through this. Lord know it wasn't your time to leave yet that is why he brought you back to us.

As a mother I feel sorry for both moms because they are in such of pain. I hope The young victim will fine a way to deal with that bad experience and take his life to Another level because God has save his life for a good reason. The dude from Chicago you wasn't Thinking right that night you had make a bad decision from what I heard stealing is not a good thing but you choose to do it because of that your life is on jeopardy at 19 you wasn't suppose to put yourself in that situation but it's too late while you there read your bible turn your life around. For the mothers my thought and prayers goes to you.

Mother always want the best for their kids. These days the young people becoming monsters because they do not have faith in the Lord they don't even know how to pray. They are believe in those non sense music with bad lyrics, no moral therefore devil fine a way to follow them, it's so sad we really need to pray for the young people too many end up in the wrong way!
