UPDATE: Attorneys Remain Tight Lipped In Settlement Over Transportation Center Lawsuit

Details of proposed settlement were expected to be announced next week.

Attorneys on both sides of a lawsuit in a $13 million lawsuit brought by a Palm Desert development company against the city of Indio are maintaining their silence about the terms of a settlement in a case involving a transportation center.

During a brief court appearance in the Larson Justice Center, attorneys for both parties told Judge Randall D. White they were not ready to disclose details of a settlement publicly.

“Some issues regarding settlement details still need to be worked out,” said Jim Touchstone, an attorney with Jones & Meyer who is representing the city, outside of court.

On Tuesday, the Indio City Council signed off on the conditions of the settlement earlier this week, according to city spokesman Chris Escobedo.

Additional details about the settlement were expected to be released next week.

Attorneys raised the possibility that both sides would move to have the case dismissed prior to their next court date, which is scheduled for June 2.

In the suit, Palm Desert-based developer KEB Enterprises alleges that the city had broken a 2007 contract under which 6.5 acres of land were to be leased to the company for $1 a year on which it would develop and operate a transportation hub.

The plans called for a 17,000-square-foot transportation center that would offer bus and train service, as well as shuttle service to area casinos.
